1. Purpose and acceptance
These terms govern the use of the Wilsoft Go app and website. By creating an account or using the service, you accept them, together with the Privacy Policy. If you do not accept them, do not use the service.
This version applies to users located in France and the European Union. A separate version applies in Canada.
2. Who we are
Wilsoft Go is operated by Wilsoft Solution Inc., a company registered in Quebec, Shawinigan (Quebec), Canada ("Wilsoft", "we"). Contact: contact@wilsoftsolution.ca.
3. Wilsoft's role: technology intermediary
Wilsoft provides a platform that connects individuals: senders with travellers who carry a parcel on a trip they are already making, and passengers with drivers who share the costs of a trip.
- Contract between users: the transport arrangement (parcel or trip) is made directly between users. Wilsoft is not a party to it.
- Not a carrier: Wilsoft is not a carrier, taxi, delivery service or freight forwarder. Wilsoft does not transport anything and never takes possession of parcels.
- Independence: drivers and travellers are independent individuals. They are not employees, agents or representatives of Wilsoft.
- Wilsoft's obligations: operate the platform with care, clearly display prices and fees before each confirmation, process online payments through its provider, apply the cancellation rules and provide support.
4. Account and verification
- Age: you must be 18 or older to create an account.
- Accuracy: you provide accurate, up-to-date information and use only one account, in your own name.
- Security: you keep your login details confidential and tell us promptly about any unauthorized use.
- Verification: some features require identity or vehicle verification. Verification reduces risk but does not guarantee a user's behaviour, reliability or solvency.
5. Lift: cost sharing, not profit
carpooling (Lift) is for sharing the costs of a trip the driver is making for their own purposes. It is not a paid transport service.
- Price: the app suggests a price per seat and applies a cap, both in the app and on our servers. The driver cannot ask for more than the cap.
- No profit: passengers' contributions should only cover part of the trip's costs (fuel, tolls, wear), not provide income to the driver.
- Applicable rules: carpooling is understood within the meaning of Article L3132-1 of the French Transport Code (trip made on one's own account, shared costs, non-profit). The driver does not use Wilsoft Go to run a commercial transport business.
- Driver: holds a valid licence and drives a roadworthy, registered and insured vehicle, and does not carry more passengers than there are seats.
6. Sending and carrying parcels
- Sender: describes the contents honestly, packs them properly and makes sure they are allowed at the places of departure, transit and arrival. The sender does not send valuables.
- Recipient: a sender who enters a recipient's name and phone number confirms they are entitled to share them.
- Traveller: takes care of the parcel, meets the agreed timing and does not open a parcel without the sender's consent, except where required by law or for safety reasons. The traveller may refuse a parcel that seems suspicious.
- Borders: each user complies with customs and import rules. Wilsoft does not handle any customs formalities.
7. Prohibited items
It is prohibited to entrust, carry or offer:
- any illegal, stolen or counterfeit item;
- drugs and narcotics, and prescription medicines intended for someone else;
- weapons, ammunition, weapon parts, explosives and fireworks;
- dangerous goods: flammable, corrosive, toxic or radioactive substances, compressed gas;
- live animals;
- cash, securities, jewellery, precious metals and any valuables;
- another person's identity or official documents;
- alcohol, tobacco, cannabis and regulated products, unless permitted by law in the places concerned;
- perishable food, unless the traveller explicitly agrees.
Wilsoft may remove a listing, suspend an account and, where required by law or in case of danger, cooperate with the authorities.
8. Prices and service fees
- Trip or delivery amount: proposed and accepted by users, within the limits set by the app. It goes to the driver or traveller.
- Service fee: Wilsoft charges a service fee on each booking, calculated as a percentage of the amount with a minimum. It funds the platform: profile verification, secure payment, support. The exact amount is always shown before you confirm.
- All taxes included: the total shown includes the trip or delivery amount and the service fee, all taxes included. Nothing is added on top.
- Price changes: fees may change, but never for a booking that is already confirmed.
9. Payment
- By card: online payments are processed by our payment provider (Stripe). Wilsoft does not store your full card number.
- Cash agreed in the app: when the app offers it and both users choose it, only the service fee are paid online. The trip amount is handed over in person to the driver or traveller. Wilsoft does not receive this money and cannot refund it; any disagreement about it is settled between the users.
- Payouts: amounts owed to drivers and travellers are paid out through our payment provider, which may require identity verification. Available payment and payout methods may vary by country; they are shown in the app.
- Receipts: a receipt is available in the app for each online payment.
10. Cancellation and refunds
- More than 24 hours before departure or the scheduled date: 100% refund, service fee included.
- Less than 24 hours before: 50% of the trip or delivery amount is refunded. The other half goes to the driver or traveller, less fees. The service fee is not refunded.
- Cancellation by the driver or traveller: 100% refund to the customer, service fee included. Wilsoft monitors repeated cancellations.
- No driver or traveller assigned yet: 100% refund, service fee included.
- Parcel already picked up: it can no longer be cancelled in the app; write to us at contact@wilsoftsolution.ca.
- Cash payment: Wilsoft can only refund amounts paid online.
- How refunds are made: always in money, to the original payment method and in the original currency, never as credit. When it appears depends on your bank.
Right of withdrawal: where the 14-day withdrawal period applies to the matching service, you expressly request that it be performed as soon as you confirm. Once the matching has been fully performed, this right can no longer be exercised (Article L221-28 of the French Consumer Code). The cancellation rules above still apply and do not reduce your legal rights.
11. Insurance and users' responsibility
- No Wilsoft insurance: at this time, Wilsoft does not provide any insurance for trips, passengers or parcels.
- Driver: checks with their insurer that their car insurance covers their trips and the people or goods carried.
- Sender: does not send valuables or prohibited items, and bears the risk related to the contents they entrust.
- Responsibility: each user is responsible for their own actions, for complying with the law and for any damage they cause to others.
12. Reviews
- Who can review: only participants in a completed trip or delivery can leave a review of the other participant.
- Content: a review is honest, based on a real experience, and contains no insults, discriminatory remarks or personal information.
- Handling: Wilsoft does not edit reviews or sort them by rating. Wilsoft may remove a review that breaches these terms or the law. A new review by the same person for the same trip replaces the previous one.
13. Prohibited conduct and reporting
- Prohibited: fraud, impersonation, harassment, discrimination, violence, illegal content, circumventing payments or price caps, unauthorized commercial use, interfering with the service.
- Report: you can report a user, listing, review or content to contact@wilsoftsolution.ca. In an emergency, call emergency services first.
14. Account suspension and closure
- By Wilsoft: in case of a breach of these terms, a safety risk, fraud or a legal obligation, Wilsoft may remove content, restrict features, or suspend or close an account, temporarily or permanently.
- Notice: we tell you about the decision and its main reasons, unless the law prohibits it or doing so would put someone's safety or an investigation at risk. You can challenge it by writing to contact@wilsoftsolution.ca; a person will review your request.
- By you: you can delete your account at any time from the app. Ongoing bookings follow the cancellation rules.
15. "Discover" directory
- Content: the Discover tab lists businesses and services. Websites open in a browser; no purchase takes place in the app. The offers, prices and content of those sites are the responsibility of their operators, not Wilsoft.
- Transparency: Wilsoft group services (Séjora, WilsoftMarket, Wilsoft Solution) are pinned and identified as such. Paid "Featured" listings are labelled as such.
- Listed businesses: a listing request is reviewed by Wilsoft, which may refuse it and give the reason. The plan's price and duration are those stated in the payment link sent after approval; there is no automatic debit. The business guarantees that its listing is accurate and that it has the right to use its name and logo.
16. Limitation of liability
To the extent permitted by applicable law, Wilsoft is not liable for damage resulting from users' acts or omissions, from carrying out the trip or transport, from a parcel's contents, from third-party sites, or from a service interruption caused by something beyond its control. The service is provided with care, without a guarantee that it will always be available and error-free.
Wilsoft remains responsible for properly performing its own obligations (Article L221-15 of the French Consumer Code). Nothing in these terms limits your right to compensation if Wilsoft fails to meet its obligations, its liability for bodily injury, gross negligence or wilful misconduct, or the legal guarantee of conformity for digital services (Articles L224-25-12 et seq. of the French Consumer Code). Where the law allows a limitation, in particular towards a business user, Wilsoft's liability is limited to the service fee paid for the transaction concerned.
17. Users' tax obligations
Each user checks their own tax and social-security obligations regarding amounts received through Wilsoft Go. Information is available at impots.gouv.fr and urssaf.fr.
18. Intellectual property
The app, website, Wilsoft trademarks and logos belong to Wilsoft Solution Inc. You keep your rights in your content (photos, reviews, listings) and grant us a non-exclusive licence to display it in the service for as long as needed to run it.
19. Dispute resolution
- 1. Complaint: first write to contact@wilsoftsolution.ca describing the problem. We reply within a reasonable time and look for a solution.
- 2. Consumer mediation: if the dispute is not resolved, you may refer it free of charge to the consumer mediator within one year of your written complaint: [TO BE COMPLETED: name, postal address and website of the consumer mediator].
- 3. Courts: failing that, the dispute goes to the competent French courts. A consumer may go to the court of the place where they lived when the contract was made or when the harmful event occurred.
- Between users: a dispute between users is settled between them. Wilsoft may share useful information it holds, but is not an arbitrator.
20. Changes to these terms
We may change these terms, for example to follow the law or changes to the service. For a significant change, we notify you at least 30 days in advance, in the app or by email, stating the new clause and its effective date. If you refuse the change, you may close your account at no cost. Bookings already confirmed remain governed by the version in force when they were confirmed.
21. Governing law and language
These terms are governed by French law, without depriving you of the protection of the mandatory rules of your country of residence. They are written in French; this English version is a translation provided for information and, in case of discrepancy, the French version prevails.
If a clause is held invalid, the others remain in force.
